Official Rules for the Crocs Top 10 Reviewers Giveaway Promotion

These official rules (“Official Rules”) shall apply to the Crocs Top 10 Reviewers Giveaway Promotion (“Promotion”) organised by Crocs Australia Pty. Ltd. (“Promoter”).

By entering this Promotion, you agree to be bound by these Official Rules and the decisions of Promoter, which is final and binding, in relation to and in connection with this Promotion. Promoter shall not be obliged to give any reason or enter any correspondence with any person on any matter concerning the Promotion.
1. Eligibility: The Promotion is open only to legal residents of Australia who are at least eighteen (18) years old as of the start of the Purchase Period. Employees of Promoter, its associated companies, and any other agencies associated with the Promotion, as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter. Promoter has the absolute discretion to determine the eligibility of entrants. Such determination shall be final and conclusive, and Promoter is not obliged to give any reason for its determination.
2. How to Enter: To enter, a) make a purchase of any footwear on www.crocs.com.au or the Crocs App (collectively, “Crocs Online Platform”) during the Purchase Period, and b) leave a review via the Crocs Online Platform after the purchase before the end of the Review Period. You must use the same email address for both purchase and the corresponding review for the entry to be valid. Purchase of one (1) footwear entitles you to leave one (1) review, which constitutes one (1) entry. There are no limits on the number of entries you can make. Message and data rates may apply to entries posted from a mobile device. Winning a prize is contingent upon fulfilling all requirements in these Terms and Conditions.
3. Purchase Period, Review Period: The Purchase Period begins at 12:00 AM AEST on 1 July 2023 and ends at 11:59 PM AEST on 30 September 2023 (“Purchase Period”). Reviews on the product(s) purchased shall be submitted before 11:59 PM AEST on 30 September 2023 (“Review Period”). Purchase(s) made before or after the Purchase Period, or not made through the Crocs Online Platform will be invalid. Review(s) submitted after the end of Review Period, or not made through the Crocs Online Platform will be invalid. Crocs’ computer is the official time-keeping device for the Promotion. Promoter reserves the right to change the Purchase Period and/or the Review Period.
4. Winner Selection: :On 17 October 2023 at 10:00 AM AEST, at the address stated below, Promoter will select ten (10) winners with the greatest number of valid entries received before the end of Review Period.
5. Prize: Ten (10) winners will each receive a voucher in the form of a unique promo code worth AUD 50 to be used on the next purchase on the Crocs Online Platform (“Prize”). The Prize is valid for one (1) year from the date of issue. Minimum purchase of $50 is required to use the Prize. Each winner is responsible for paying taxes and any costs and expenses not specified herein, including any applicable shipping fees. Any Prize details not specified above will be determined by Promoter, in its sole discretion. The winners may not request cash, credits or a substitute prize; however, Promoter reserves the right to substitute a prize with another prize if the Prize is not available for any reason, as determined by Promoter, in its sole discretion. Use of the Prize shall be subject to Promoter’s terms and conditions.
6. To Find out Who Won: Within seven (7) days of the selection, the list of winners will be announced on this page and each winner will be notified by Promoter through the email address you used to make the purchase and submit the review.
7. Winners Announcement: Thank you for participating in the Write A Review 2023 campaign. We are happy to announce our top 10 winners below. Winners are entitled to receive a voucher worth AUD 50 valid for 1 year from date of issue and to be used on the next purchase on Crocs.com.au/ Crops App. Winners will be notified through the email address which was used to submit the review.

8. Redemption Requirements: Except where prohibited, each winner may be required to complete and return a declaration of eligibility and liability/publicity release. If a winner fails to respond to Promoter with the required information within seven (7) days, he/she will forfeit the Prize, without liability to Promoter. If Promoter discovers that a winner was not entitled to participate or if a winner is subsequently disqualified from participating in the Promotion, Crocs may at its discretion forfeit the Prize. An entrant whose Prize has been forfeited shall not be entitled to any payment or compensation whatsoever from Crocs. There will be no re-selection conducted for any Prize forfeited. No correspondence or claims will be entertained in the event of such forfeiture.
9. General Conditions: In the event that the operation, security, or administration of the Promotion is impaired in any way, Promoter may, in its sole discretion, either: (a) suspend the Promotion to address the impairment and then resume the Promotion; or (b) award the Prizes from among the valid entries received up to the time of the impairment. Promoter reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Promotion, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Promoter by mail shall not be deemed proof of receipt of that communication. The Promotion is subject to federal, state, and local laws and regulations and is void where prohibited. In the event of any inconsistency between these Official Rules and any advertising, promotional, publicity and other materials relating to or in connection with the Promotion, these Official Rules shall prevail.
10. Privacy and Publicity: The Promoter collects personal information of entrants to this Promotion in order to conduct and administer the Promotion. Any information you submit as part of the Promotion will be treated in accordance with Promoter’s Privacy Policy. By participating in this Promotion, you agree to the Privacy Policy. Except where prohibited, participation in the Promotion constitutes an entrant’s consent, in the event he/she is the winner of a prize, to Promoter’s use of his/her name, likeness, and state of residence for promotional purposes in any media without further payment or consideration.
11. Release and Limitations of Liability: Nothing in these Official Rules excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be lawfully excluded, restricted or modified by agreement (Non-Excludable Guarantee). To the extent permitted by law, the Promoter’s liability for breach of any Non-Excludable Guarantee is limited to the cost of replacement of any benefit or Prize won. Subject to the foregoing, by entering the Promotion: (a) you agree to release and hold harmless Promoter, its affiliates, and advertising and Promotion agencies, and each of their respective officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action (whether in contract, tort (including negligence) or otherwise) arising out of participation in the Promotion or receipt or use of any Prize, including, but not limited to (i) unauthorized human intervention in the Promotion; (ii) technical errors related to computers, servers, providers, or telephone or network lines; (iii) printing errors; (iv) lost, late, postage-due, misdirected, or undeliverable mail; (v) errors in the administration of the Promotion or the processing of posts; or (vi) injury or damage to persons or property; (b) you further agree that in any cause of action, in no event shall the Released Parties be liable for attorneys’ fees or other legal costs; and (c) you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. For the avoidance of doubt, cancellation, termination or suspension by Promoter of this Promotion shall not entitle any party to any claim or compensation against Promoter for any and all losses or damage suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.
12. Disputes: Any and all disputes, claims, and causes of action arising out of, or connected with, the Promotion or any Prize awarded shall be resolved exclusively by the appropriate court located in the state of Victoria, Australia and any courts of appeal from them. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Promoter in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Victoria, Australia, without giving effect to any choice of law or conflict of law rules (whether of without or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than without.
